This Privacy Policy describes the privacy practices of Very Jane LLC (“Jane”, “we”, “us”, or “our”) and how we handle personal information that we collect through our website, https://jane.com/, through Jane’s mobile iOS and Android applications, and through any other websites or services that we own or control and that link to this Privacy Policy (collectively, the “Service” or “Services”).

This Privacy Policy applies to buyers of products on the Services (“Buyers”), sellers (“Sellers”), those who purchase items on Jane without an account, and anyone else who visits or uses our Services (together, “you” and “your”).

This Privacy Policy does not apply to the practices of third parties (including Sellers) who you may choose to share information with when you use the Services. Please note that the collection and use of your personal information by these third parties is subject to their own privacy policies and terms. You should review the privacy and security practices of any third party before you share information with them.

Personal Information We Collect

Depending on the type of user that you are (Buyer, Seller, or Service visitor), we collect personal information about you when you register with, sell or purchase items on, or otherwise use our Services. The types of personal information we may collect are as follows:

  • Contact details, such as your first and last name, email and mailing addresses, delivery address, and phone number.
  • Account information, such as the email address and password you use to access our Services.
  • Payment information needed to complete your transactions with us, including name, payment card information, and billing information. This information is processed by third-party payment processors. The third-party payment processors will handle your payment information in accordance with their own privacy policy. We do not have access to your full payment card information.
  • Communications that you send through the Services, such as when you contact us or Sellers with questions, feedback, or otherwise.
  • Shopping history, such as information about the items you viewed, added to your cart, purchased, or returned, and your shopping preferences.
  • Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Automatic data collection

We, our service providers and our advertising partners may automatically log and combine information about you, your computer or mobile device, and your interaction over time with the Services, online resources, and our communications, such as:

  • Device data such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings. and general location information such as city, state, or geographic area.
  • Online activity data such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Services, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access, and whether you have opened or otherwise engage with our communications, such as our marketing emails or clicked links or files within them.

We use the following tools for automatic data collection:

  • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitate online advertising. We may also use third-party cookies and similar technologies to identify email addresses of website visitors who leave the website without purchasing anything, and use those email addresses for marketing and advertising purposes (for more information, please see the “Information we obtain from other sources” section below).

  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
  • Session replay technologies. We use services provided by our third-party service providers that employ cookies and local storage technologies to record and allow us to review replays of user sessions. The replays include users’ clicks, mouse movements, scrolls, text entered, and time spent on the webpage during those sessions and other data. These replays help us understand the activity occurring on our Services.

Information we obtain from other sources:

  • Third-party accounts. When you log into the Services through a third party account, such as Google, we may collect certain information from your account (e.g., name, email address, user name), depending on the privacy permissions you have configured within that account.
  • Social media information. We may maintain pages on social media platforms, such as Facebook, Twitter, TikTok, YouTube, Pinterest, and LinkedIn. When you visit or interact with our pages on those platforms, you or the platforms may provide us with information through the platform.
  • Other sources. We may obtain personal information from other third parties, such as marketing partners, publicly-available sources, and data providers. For example, we use third-party cookies and similar technologies provided by GetEmails, LLC dba Retention.com and other data partners or vendors, to collect personal information about website visitors (such as an email address) who leave the website without purchasing anything or filling out a form. This information is used by our data partners or vendors to identify email addresses of visitors. We (or service providers on our behalf) may then send marketing and advertising communications to these email addresses. You may opt out of the use of your personal information for such marketing and advertising purposes in relation to Retention.com by visiting https://app.retention.com/optout.

How We Use Personal Information

We use personal information for the following purposes or as otherwise described at the time of collection:

Provide our Services. We use personal information to operate, maintain, and provide you with our Services, which includes processing and fulfilling your orders and requests for our products or services, and processing your returns.

Communicate with you about our Services . We use personal information to respond to your requests, provide customer support, communicate with you about our Services, including by sending announcements and updates, such as regarding your order status and shipment, and request feedback about our products and Services.

Contests and other promotions . We use personal information to administer and fulfill our contests and other promotions, and to communicate with you about such initiatives.

How We Disclose Personal Information

We may disclose personal information to:

Service providers. Companies and individuals that provide services on our behalf or help us operate the Services or our business (such as ecommerce platform, hosting, information technology, customer support, email and text message delivery, marketing services, research and analytics services).

Sellers. When you purchase products on our Services, you direct us to disclose your information to Suppliers of the relevant products to fulfil your orders, complete returns and address customer service issues. This includes your first and last name, shipping address, phone number, email address and order information.

Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

Authorities and others. Law enforcement, government authorities and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Business transferees. Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Jane (including, in connection with a bankruptcy or similar proceedings).

Advertising partners. Third party advertising companies, including for the interest-based advertising purposes described above.

Publicly displayed information: By using the Services, certain information about you will be publicly displayed on the Services, such information you may include in a product review, and Seller profile or shop information. Your reviews of shops or items you’ve purchased may also be shared on other platforms and search engines, including Google.

Privacy Rights and Choices

Opt-out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions in the emails you receive from us. You may opt out of receiving text messages from us by replying “STOP” to the text message you receive from us. You may also opt out of receiving marketing communications from us by contacting us as provided in the “Contact Information” section above. You may continue to receive Services-related and other non-marketing communications.

Limit online tracking. There are a number of ways to limit online tracking, which we have summarized below. Please note that these opt-out tools are not associated with Jane, and we cannot guarantee that these tools work as their providers advertise them:

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.   • Advertising Industry Opt-Outs. You may be able to manage third-party advertising preferences for some of the third parties we work with by using the opt-out options available at:

  • Blocking advertising ID use in your mobile settings. Your mobile device settings can provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
  • Using privacy plug-ins or browsers. You can block our website from setting cookies by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers. You can also opt out of Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout.
  • Platform opt-outs. Some of our advertising partners offer opt-out features that let you opt out of use of your information for interest-based advertising, including:

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Personal information requests. We offer you choices that affect how we handle the personal information that we process. Depending on your location and the nature of your interactions with our Services, you may request the following in relation to personal information:

  • Information about how we have collected and used personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.
  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Correction of personal information that is inaccurate or out of date.
  • Deletion of personal information that we no longer need to provide the Services or for other lawful purposes.
  • Opt out of selling personal information and sharing for targeted advertising. We share information with third-party advertising partners and allow them to collect information about your use of the Services to show you ads on our Services as described in the “How we use personal information” and “How we disclose personal information” sections above. Our disclosure of information to these partners may be considered a “sale” or “sharing” of personal information or “targeted advertising” under applicable laws. Limits on your privacy rights and choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. Other Sites and Services

Our Services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or online services operated by third parties, and we are not responsible for their actions. This Privacy Policy does not apply to such third-party sites or services.

Security

We use reasonable organizational, technical and administrative measures designed to protect against unauthorized access, misuse, loss, disclosure, alteration and destruction of personal information we maintain. Unfortunately, data transmission over the Internet cannot be guaranteed as completely secure. Therefore, while we strive to protect your personal information, we cannot guarantee the security of personal information.

Children’s Privacy

You must be at least 18 years of age to access and use the Services. If you are under 18, you may use our Services only with the involvement of a parent or guardian. We do not knowingly collect through the Services personal information from children under the age of 13. If we learn that we have collected personal information through the Services from a child under 13 without the consent of the child’s parent or guardian as required by law, we will delete it.

Retention of Personal Information

Where required under applicable laws, we retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and processed, and in accordance with applicable laws and regulatory obligations.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we use personal information and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.

Notice of Financial Incentive

We provide discounts or promotions when you sign up on our Services to receive marketing and promotional communications from us or refer a friend. We may also provide other programs, such as sweepstakes, contest, or other similar promotional initiatives (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number), or in case of our “refer a friend” Program, the email address of your friend. Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law.

The value of personal information to us is reasonably related to the amount of the discount offered for consumers who enroll in the Programs. We estimate the value of personal information to us based on consideration of multiple factors, including the revenue generated by us in developing insights on our customers; the likelihood of consumers making recurrent purchases as a result of receiving discounts; the expenses incurred by us in operating our Programs; and our reasonable assessment of revenue we may generate as a result of the referrals provided to us by our customers.

Job Applicants

If you apply for a job via our website, we collect the information that you provide to us in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history and other information of the type that may be included in a resume. This may also include diversity information that you voluntarily provide. We use this information to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, to monitor recruitment statistics and to respond to surveys.
